It is expected that the Superior Electoral Court of Brasilia will approve a resolution this year to regulate the use of Artificial Intelligence in the municipal elections in October. The date for voting on the resolution has not yet been set, however, a public hearing on the rules will be held before the end of the month.
The Electoral Tribunal aims to prohibit the use of manipulated voices and images, known as deep fakes, that spread misinformation to undermine election fairness and propagate negative propaganda against candidates and parties on social media and during electoral campaigns.
Their goal is to prevent the spread of these manipulated setups, created by Artificial Intelligence applications to deceive with false statements from candidates and authorities involved in the electoral process.
Responsibility
According to the court’s draft resolution, platforms will be held accountable for removing false content. Upon receiving a notification, providers must take action to delete the material from the internet and conduct thorough investigations into the source of the publication. Additionally, platforms must refrain from promoting posts that contain misinformation.
According to the initial rules, manipulating content could result in a punishment of between two months and one year of imprisonment, as well as a fine.
Fact-checking agencies that collaborate with the court will be empowered to categorize the content as false, true, or taken out of context.
The public hearing, scheduled from January 23rd to 25th, will be led by Judge Cármen Lúcia, who will preside over the Superior Electoral Court during the municipal elections in October for mayors, vice mayors, and councilors.
